1. Introduction

Welcome to StudyBeats! These Terms and Conditions ("Terms") govern your use of our mobile application (the "App") operated by Mustafa Emre Taflan ("we," "our," or "us").

2. Description of Service

StudyBeats is an educational tool that uses Artificial Intelligence (AI) to transform study materials (notes, PDFs, images, topics) into songs to aid memorization and learning. We utilize third-party AI services, including OpenAI, Anthropic, and Suno, to generate this content.

3. User Accounts

To use most features of the App, you must register using your Google or Apple account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

4. Subscriptions and Credits

4.1. Free vs. Premium

StudyBeats offers a limited free tier and paid subscription tiers ("Plus" and "Pro").

• Free Tier: Limited number of song generations per month.
• Premium Tiers: Unlocks additional features such as more generations, premium genres, and higher quality downloads.

4.2. In-App Purchases

Subscriptions and credit refills are purchased via the Apple App Store or Google Play Store.

• Billing: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Refills: One-time purchases for additional generation credits do not expire but are non-refundable.
• Refunds: All purchases are final. Refunds are handled exclusively by the respective App Store in accordance with their policies.

5. User Content and AI Usage

5.1. Your Content

You retain ownership of the study materials (notes, PDFs, images) you upload to the App. By uploading, you grant us a license to process this content through our AI providers solely for the purpose of generating your songs.

5.2. AI-Generated Content

• Ownership: Subject to the terms of our AI providers (Suno, Anthropic, OpenRouter), you own the rights to the specific songs generated for you, to the extent permitted by law.
• Accuracy: AI generation creates content based on probabilities. We do not guarantee the factual accuracy of the lyrics generated. You should always verify the educational content against your original study materials.
• Availability: We rely on third-party APIs. We cannot guarantee 100% uptime for song generation features.

6. Prohibited Uses

You agree not to use the App to:

• Generate harmful, infringing, obscene, or illegal content.
• Upload copyrighted materials that you do not have the right to use.
• Reverse engineer or attempt to extract the source code of the App.
• Exploit the AI generation system in a way that degrades service for others.

7. Intellectual Property

The App itself (excluding your user-generated content), including its original content, features, and functionality, are and will remain the exclusive property of Mustafa Emre Taflan and its licensors.

8. Limitation of Liability

To the maximum extent permitted by law, StudyBeats and Mustafa Emre Taflan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any conduct or content of any third party on the App
• Unauthorized access, use, or alteration of your transmissions or content

9. Disclaimer

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the reliability, accuracy, or availability of the service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
